TERMS & CONDITIONS

This document (Terms & Conditions) defines the applicable conditions to sales made between on the one hand the people wishing to purchase via the website of La Botte Gardiane http://www.labottegardiane.com, one after referred to as " the customer "and secondly the company MAG SARL - La Botte Gardiane located ZA Lallemande RN113, 30670 Aigues-Vives, registered with the RCS Montpellier under number B 402 115 422, SARL with capital of € 7,622.00, the number of VAT is FR55402115422, one after referred to as "The Botte Gardiane". These conditions relate exclusively to non-commercial individuals.

1. EXCHANGE, RETURN AND REFUND

Return of a standard item:

In accordance with the law, the customer has a period of 30 clear days to exercise his right of withdrawal from the date of receipt of the goods, subject to compliance with the conditions set out in the paragraph below. Any exchange or return must be requested by email at info@labottegardiane.com. The cost of returning an unsuitable item is borne by the customer. Shipping costs for a new product, if applicable, are the responsibility of La Botte Gardiane.

Return of a personalized/taylor-made article:

For all our personalized or taylor-made products (boots, low boots and sandals), the right to withdrawal cannot apply, in accordance with the provisions of Article L 222-7 of the Consumer Code as amended by Order No. 2001-741 of 23 August 2001. In particular, withdrawal is excluded (Article 221-28) for contracts for the supply of goods clearly personalized or made up according to the consumer’s specifications, or in particular for taylor-made articles, i.e.: all non-standard items and items with specific additions or modifications (wide foot, strong instep, special colors, special soles, etc.).However, if the shoe is not suitable (size, or problem regarding the made-to-measure option) an exchange remains possible, within 30 days, in this case please contact the customer service by email at info@labottegardiane.com or by phone at 04 66 73 20 85.

Condition of products:

All returned products (shoes, original packaging, accessories, ...) must be returned perfectly intact. Upon receipt of the package, La Botte Gardiane will consider the returned goods to be in perfect condition. No return will be accepted if the returned products have been visibly used or damaged by the customer and such use or damage makes the products unfit for sale. If the return is refused by La Botte Gardiane, the products will then be returned to the customer at the expense of La Botte Gardiane without the customer being able to demand any compensation or right to refund, with the exception of the subsequent exercise of its rights to guarantee on the goods sold. Subject to compliance with these conditions of return, La Botte Gardiane will refund the returned products within 14 days following the return to stock of the goods, excluding return costs, in accordance with law. In the context of an exchange, the shipping and delivery deadlines will apply.

If the amount of the order exchange of the customer is greater than the amount of his initial order, he will have to pay the difference by credit card or transfer (a special order link will be created and sent to him by email). The customer can also pay by check and send it the following address: La Botte Gardiane, ZA Lallemande RN113, 30670 Aigues-Vives. The shipment of the customer exchange order is conditioned by the validation of this regulation. If the amount of the customer’s exchange order is less than the amount of the original order, La Botte Gardiane will refund the difference.

2. PRICES

All the prices of the products are indicated in euros all taxes included (excluding EU), shipping costs included for metropolitan France, Corsica and Monaco. For other destinations, a surcharge will be charged, the amount of this surcharge varies depending on the destination. La Botte Gardiane reserves the right to change its prices at any time without notice. The products will be invoiced based on the rates in effect at the time of order registration. The products remain the property of La Botte Gardiane until the complete collection of the price by La Botte Gardiane. The price is payable in full and in one installment.

3. ORDER

Customers can order online at www.labottegardiane.com or by phone from Monday to Friday from 08:00 to 18:00 at +33 4 66 73 20 85. La Botte Gardiane reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or which would present in its eyes some form of risk. Any order constitutes acceptance of the prices and description of the products available for sale.

La Botte Gardiane undertakes to honor the orders received on the website only within the limit of available leather stocks and possible restocking. If one or more products(s) ordered are not available, La Botte Gardiane undertakes to inform the customer as soon as possible. The customer’s order will then be automatically cancelled and the corresponding amount refunded.

4. SHIPPING AND DELIVERY

Shipping times vary between 2 business days (if the pair is in stock) and 4 weeks. These deadlines depend on the workload of La Botte Gardiane and the speed of restocking in raw materials of its suppliers (leathers in particular). The average shipping times observed are 2 weeks from the validation of the order. We remind you that all our products are entirely made in France in our workshop, except leather care products.

  • for metropolitan France, Corsica and Monaco: the parcels are routed either by Colissimo Suivi, or by DPD, with a delivery in the selected relay point. The delivery time is guaranteed in 48 hours.
  • for Europe and overseas departments: your package will be shipped either via La Poste (Colissimo International/Overseas with proof of delivery) either via DPD or via Chronopost. The average delivery time is 8 days (working days).
  • Outside Europe and for TOM: parcels are shipped via La Poste (Colissimo International with proof of delivery), or via Chronopost. The average delivery time is 6 to 18 days (working days) depending on the destination.Excluding metropolitan France, Corsica and Monaco, a shipping fee will be applied for delivery costs. The amount of this fee will be defined according to the destination.In case of payment by cheque, the order will be processed only upon receipt of the cheque. Accordingly, the time limits applicable in this case shall run from the day of receipt of the cheque.

If the shipping time agreed with the customer is exceeded (minimum 4 weeks after payment), the customer can cancel his order and be refunded, including for custom orders. La Botte Gardiane undertakes to reimburse the buyer within a maximum period of 14 days.

5. PAYMENT

- By credit card: Visa, MasterCard, Carte Bleue

- By transfer

- By check from a bank based in France

In case of payment by check, it must be issued by a bank domiciled in metropolitan France and made out to the order of La Botte Gardiane. Please contact La Botte Gardiane, Customer Service, ZA Lallemande RN113, 30670 Aigues-Vives. Products ordered in stock are reserved 10 days from the date of order. After this period and failing receipt of the corresponding cheque, the ordered product will then be returned to stock. Cashing is done upon receipt of the check. The payment is validated upon receipt of the check and of the additional information requested in case of payment by credit card requiring extra checks.

7. INTELLECTUAL PROPERTY

All texts, commentaries, books, illustrations and images reproduced on La Botte Gardiane are reserved under copyright as well as intellectual property and for the whole world. As such, and in accordance with the provisions of the Intellectual Property Code, only use for private use is permitted, subject to different or more restrictive provisions of the intellectual property code. Any total or partial reproduction of the site of La Botte Gardiane is strictly prohibited unless prior agreement.

8. GUARANTEES

All Products sold on the Website benefit from the legal guarantee of conformity (articles L217-1 and following of the Consumer Code) and the guarantee against hidden defects (articles 1641 and following of the Civil Code), allowing you to return defective or non-compliant Delivered Products. You are informed that La Botte Gardiane, whose registered office is ZA Lallemande RN-113, 30670 Aigues-Vives, is the guarantor of the conformity of the Products to the contract within the framework of these two legal guarantees.

You have a period of two years from the date of issue of the Product to act in application of the legal guarantee of conformity. In this case, you may choose to repair or replace the Product, subject to the cost conditions set out in Article L217-9 of the French Consumer Code. For contracts concluded as of March 18, 2016, you are exempt from reporting proof of the existence of the lack of conformity of the Product during the twenty-four (24) months following the issue of the Product. For previously concluded contracts, the default is presumed to last for six (6) months. It is recalled that the legal guarantee of conformity applies regardless of any commercial guarantee that may be granted to you by La Botte Gardiane.

In addition, you can decide to implement the warranty against hidden defects of the thing sold within the meaning of article 1641 of the Civil Code. In this case, you can choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.

9. RESPONSIBILITY

The company La Botte Gardiane has, for all the steps of access to the site, the process of order, delivery, customer service or subsequent services, only an obligation of means. La Botte Gardiane cannot be held liable for any inconvenience or damage inherent in the use of the internet network, in particular a breakdown of the service, an external intrusion or the presence of computer viruses, or any fact qualified as force majeure, in accordance with case law.

10. PRIVACY POLICY

All personal data communicated by the Customer to La Botte Gardiane are subject to computer processing intended for the processing and delivery of orders. La Botte Gardiane guarantees that all data (name/surname of use, e-mail, telephone number, etc...) are kept internally and will not be transferred under any circumstances without the authorization of its owner or the consent of the guardian of the minor if the owner is a minor under 16 years of age. La Botte Gardiane undertakes to return its data to anyone who wishes to recover it. Minors under the age of 16 must obtain an agreement from their guardian in order to transmit their data. As adults, data owners can retrieve the data by withdrawing their consent. In accordance with the amended Data Protection Act No. 78-17 of 6 January 1978, the processing of the customer’s personal data is the subject of a declaration to the CNIL and the customer has a right of access, modification, rectification and deletion of data concerning him by contacting La Botte Gardiane ZA Lallemande RN-113, 30670 Aigues-Vives – info@labottegardiane.com. The Customer can subscribe to the La Botte Gardiane newsletter and thus choose to be regularly informed of the news of La Botte Gardiane. It has the possibility to unsubscribe as soon as it wishes by clicking on the link provided for this purpose on each of the newsletters.

11. MEDIATION

To comply with the provisions of the Consumer Code concerning the amicable settlement of disputes, La Botte Gardiane will soon inform you of the mediator service to which it is attached. After a prior written request from consumers to La Botte Gardiane, the mediator service may refer any consumer dispute that has not been settled. At the European level, the European Commission provides you with an online dispute resolution platform.
